Terms and Conditions of Sales

1. Price and Payment Terms Customer agrees to pay the total purchase price as specified on the front of this document. In addition, the customer agrees to pay any applicable federal, state, and other government taxes. Seller’s terms of payment are based on date on invoice, total to be paid as specified on face of this document under “terms”. Beyond this period, invoices are considered to be past due. Past due payments will be subject to a service charge of one and one-half percent (1 ½%) per month or the maximum amount allowed by law, whichever is less. Until the purchase price and all other charges payable to Seller hereunder have been received in full, Seller hereby retains a security interest in the products delivered to Purchaser and any proceeds therefrom. Customer agrees to pay $20.00 charge for any returned check and all collection costs including legal fees if applicable. In the event of a dispute or litigation between parties, depending on the store from which the merchandise is purchased, it is hereby agreed that jurisdiction and venue shall vest in Utah County, Utah.
2. Acceptance Customer shall examine all goods promptly upon receipt thereof, and must notify seller within three (3) days of such receipt of any error. Customer shall notify Seller in writing of all claimed shortages and defects. Otherwise, the goods will be deemed accepted as of the date of shipment.
3. Limitation of Liability Squitoey Technologies and Computers shall not be liable under any circumstances for any special, consequential, incidental, or exemplary damages arising out of or in any way connected with this agreement or the products, including but not limited to damages for lost profits, loss of use, or lost data. Statement or descriptions of products, if any, by Squitoey Technologies and Computers are informational only, and not made or given as a warranty of any kind. Squitoey Technologies and Computers sells the products without any express or implied warranty of any type and particularly without any implied warranty of merchantability or fitness for a particular purpose. In the event of any product defect or nonconformity, Customer’s sole remedy shall be the replacement of nonconforming products or, at Squitoey Technologies and Computers’ option, a refund of the purchase price.
4. Warranty Squitoey Technologies and Computers warrants, to the original purchaser, the hardware against all defects in materials and workmanship for one year from the date of purchase. In the event any hardware has a manufacturer’s warranty beyond one year, it is the customers’ responsibility to deal directly with the manufacturer for any repairs or replacements that occur beyond the one-year warranty period. During the one-year warranty period, Squitoey Technologies and Computers will repair or replace all hardware, which prove to be defecting, with labor charges waived. Warranty does not cover free installation of software or operating systems. Squitoey Technologies and Computers will not warrant any Goods, which have been subjected to improper freight handling/shipping, abuse, neglect or modification by any party other than Squitoey Technologies and Computers.
5. Return Policy Merchandise may be returned for a full refund within 7 days from the date of invoice. Returns from 8 to 30 days are subject to a 15% restocking charge. There will be no returns or exchanges allowed after 30 days. Merchandise shall be in original package and condition, including all accessories and manuals to be eligible for refund or replacement. Customer must contact Squitoey Technologies and Computers RMA Dept. to request an RMA number before sending the product to Squitoey Technologies and Computers. A copy of the invoice and a brief explanation of the problem are also required. Returns without an RMA number will be rejected. Squitoey Technologies and Computers reserves the right to deny a return or an exchange.
6. Refund Policy Purchases made by cash or check in excess of $25.00 will be refunded by a company check issued from Squitoey Technologies and Computers headquarters in Pleasant Grove UT. Squitoey Technologies and Computers has the right to delay your refund to allow time for your original check to clear. No cash or check refund will be issued to credit card purchases.
